Terms of Service

It is not a medical device, not approved by the MHRA, FDA, or any other regulatory body, and is not intended for the diagnosis, prevention, treatment, or mitigation of any disease, illness, or medical condition. § 01

About These Terms

These Terms of Service ("Terms") constitute a legal agreement between you ("User", "you") and College of Human and Business Efficiency Ltd, a private limited company registered in England and Wales, trading as "PYTHIA" and operating the website pythiaoracle.com ("PYTHIA", "we", "us", "our").

By creating an account, accessing, or using the PYTHIA software, services, or website (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Medical Disclaimer. If you do not agree, you must not use the Service.

You must be at least 18 years of age to use the Service. By using the Service, you confirm that you are 18 or older.

Nature of the Service

PYTHIA is an experimental software application that allows users to record their voice, generate algorithmic acoustic analyses based on voice signal properties, and produce personalised audio frequency outputs ("protocols") intended for self-directed personal practice in the field of frequency exploration, sound experimentation, and meditative or relaxation use.

By using the Service, you acknowledge that you have no expectation of curing, treating, or alleviating any ailment, condition, or symptom. The Service is provided for educational, experimental, and personal exploratory purposes only.

§ 03

Account Registration

3.1 Personal Account

Each account is strictly personal. One account corresponds to one individual user. You may not share your account credentials with any other person. You are responsible for maintaining the confidentiality of your password and for all activities under your account.

3.2 Multiple Profiles

Certain subscription tiers ("Seeker Couple", "Family", "Practitioner") permit additional profiles for use by specific named individuals (family members, clients, etc.). Each profile represents one distinct biological field. Using profiles to process recordings from individuals other than the named profile holder will produce inaccurate algorithmic outputs and violates these Terms.

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information as needed. We reserve the right to suspend or terminate accounts containing false or misleading information.

§ 04

Subscriptions and Payment

4.1 Subscription Tiers

PYTHIA offers multiple subscription tiers with varying features, recording allowances, and profile limits. Current pricing and features are displayed on the website. We reserve the right to modify tier features and pricing with reasonable notice.

4.2 Billing

Subscriptions are billed in advance on a recurring monthly basis via Stripe, our payment processor. By subscribing, you authorise us to charge your payment method for the subscription fee at the start of each billing period.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period; you retain access until that date.

4.4 Recording Allowances

Each tier includes a specific monthly recording allowance. Unused recordings do not roll over to the following month. Allowances reset at the start of each billing period.

4.5 Price Changes

We may change subscription prices with at least 30 days' written notice (via email or in-app notification). Continued use of the Service after a price change constitutes acceptance of the new price.

§ 05

Cancellation and Refunds

5.1 14-Day Right to Cancel (UK Consumer Rights)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a UK consumer purchasing a subscription, you have the right to cancel within 14 days of your initial subscription purchase ("Cooling-Off Period") and receive a refund.

To exercise this right, you must inform us of your decision to cancel before the 14-day period expires. You may do this by:

5.2 Limitation on Refunds After Use

Important: Under the same regulations, if you have actively used the Service within the 14-day Cooling-Off Period (for example, by completing one or more voice recordings, generating protocols, or downloading audio files), you acknowledge that the digital service has been supplied and you may forfeit your right to a full refund. We may, at our discretion, offer a partial refund proportionate to use.

5.3 Refunds After 14 Days

After the 14-day Cooling-Off Period, subscription payments are non-refundable. Cancellation will stop future billing but does not refund the current billing period.

5.4 Exceptional Circumstances

In exceptional circumstances (such as significant technical failure preventing access to the Service), we may issue refunds or service credits at our sole discretion.

Acceptable Use

You agree to use the Service only for lawful, personal, and experimental purposes. You agree NOT to:

Voice Recordings and Data

7.1 What Happens to Your Recordings

When you record your voice in the Service, the audio file is temporarily processed on our servers for the purpose of algorithmic acoustic analysis. The raw audio file is deleted immediately after analysis. We retain only the extracted acoustic parameters (frequency measurements, harmonic data, timing characteristics) as part of your personal session history.

7.2 No Biometric Identification

PYTHIA does not perform speaker identification, voice authentication, or any form of biometric recognition. Your voice recording is processed solely for acoustic parameter extraction.

§ 08

Intellectual Property

8.1 Ownership

The PYTHIA software, algorithms (including but not limited to QuaSyn simulation engine, voice analysis pipelines, aetheric field models, harmonic gap detection, and personal resonance learning architecture), source code, design, content, branding, and all associated intellectual property are owned exclusively by College of Human and Business Efficiency Ltd. All rights are reserved.

8.2 Limited Licence to Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

8.3 Your Outputs

Audio files, frequency protocols, session reports, and other outputs generated by the Service from your voice recordings ("Outputs") are yours to use for personal, non-commercial purposes. You may not resell, redistribute, or commercially exploit Outputs without our written agreement.

8.4 Trademarks

"PYTHIA", "ANAX", "QuaSyn", "VICCA ONE", and associated logos, names, and visual identifiers are trademarks or trade names of College of Human and Business Efficiency Ltd or its associated entities. You may not use them without our written permission.

§ 09

Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

Limitation of Liability

To the maximum extent permitted by law:

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.

Indemnification

You agree to indemnify, defend, and hold harmless College of Human and Business Efficiency Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

12.1 Termination by You

You may terminate your account at any time through your account settings or by contacting us. Termination does not entitle you to a refund of subscription fees already paid (except as set out in Section 5).

Upon termination, your access to the Service ceases. We will delete or anonymise your personal data within 90 days of termination, except where retention is required by law.

Service Availability and Changes

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our reasonable control. We may modify, add, or remove features of the Service at any time. Material changes will be communicated via email or in-app notification.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where you are a consumer based in another jurisdiction with mandatory protective laws, in which case those laws apply.

Consumer Rights

If you are a consumer based in the United Kingdom, nothing in these Terms affects your statutory rights as a consumer under English law, including but not limited to the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

If you are a consumer based in the European Union, you have similar protections under EU consumer law.

§ 16

Changes to These Terms

We may update these Terms from time to time. Material changes will be notified to you by email or via in-app notification at least 14 days before they take effect. Your continued use of the Service after the effective date of changes constitutes acceptance. If you do not agree, you must stop using the Service and cancel your subscription.

§ 17

Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and us regarding the Service.
